Terms of Service

These terms govern your use of our online estate planning service. Please read them before you begin.

About these terms

This website is operated by SimplyClose Law Professional Corporation, operating as Mariotti Law Group, a law firm regulated by the Law Society of Ontario. By creating an account or using this service, you agree to these terms. If you do not agree, please do not use the service.

What we provide

We offer an online way to begin your estate plan. You answer a guided questionnaire, a licensed Ontario lawyer reviews your answers and prepares your documents, and you sign them in person at our Windsor office. Depending on the plan you choose, your documents include a Last Will and Testament, a Power of Attorney for Property, and a Power of Attorney for Personal Care.

A solicitor-client relationship is formed only once we have accepted your matter, you have completed payment, and we have confirmed that we are acting for you. Until then, completing the questionnaire does not create a lawyer-client relationship, and you should not rely on the site as a substitute for advice about your specific situation.

Who can use the service

  • You must be at least 18 years of age and have the legal capacity to make a will and powers of attorney.
  • The service is designed for Ontario residents and estates governed by Ontario law.
  • If your situation is complex (for example, a business, a blended family, trust planning, or significant or out-of-province assets), please call us before starting so we can advise on the right approach.

Fees and payment

Our fees are flat and shown before you begin: $599 for an individual plan and $899 for a couple plan, in Canadian dollars, plus applicable taxes. Payment is processed securely by our payment provider. Genuinely complex estates may require a different fee, which we will discuss with you before any work begins.

Cancellation and refunds

You may cancel before your documents are finalized and signed. If you cancel, we will refund the portion of the fee that reflects work not yet performed, in line with our professional obligations regarding fees. If you have questions about a refund, contact our office and we will work with you.

Your responsibilities

  • Provide accurate, current, and complete information. Your documents are only as good as the information you give us.
  • Keep your account login confidential.
  • Review your documents carefully before signing, and ask us about anything you do not understand.
  • Attend your signing appointment so your documents can be properly witnessed and signed.

Signing and document storage

Your documents are signed in person and witnessed in accordance with Ontario law. You receive a copy, and you may keep your signed originals yourself or have us hold them in secure storage at our Windsor office. If we store them, your executor contacts us when the time comes and we release them. You may request to retrieve or update your documents at any time.

Intellectual property

The content, design, and software of this website are owned by the firm or its licensors and are protected by law. You may use the site only to obtain our services. The documents we prepare for you are yours to keep and use for your estate planning.

Limitation of liability

To the fullest extent permitted by law, the firm is not liable for indirect, incidental, or consequential damages arising from your use of this website. Nothing in these terms limits any liability that cannot be limited or excluded under applicable law or under the rules governing the conduct of lawyers in Ontario.

Governing law

These terms are governed by the laws of the Province of Ontario and the laws of Canada that apply there. Any dispute will be subject to the courts of Ontario.

Changes to these terms

We may update these terms from time to time. When we do, we will revise the “last updated” date above. Your continued use of the service after a change means you accept the updated terms.
